Terms of Service

1. These terms

These Terms of Service ("Terms") are a legal agreement between you and Pulser, operated by Maximillian Faulhaber (sole trader) ("Pulser", "we", "us", "our") and govern your access to and use of the PULSER website, dashboard, and services at pulser.pro (the "Service").

By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

The Service is intended for businesses and sellers. You must be at least 18 years old and able to enter into a binding contract. By using the Service you confirm you use it for purposes related to your trade, business, craft, or profession.

3. The Service

Pulser provides tools for product research, AI-assisted listing generation, supplier sourcing, and publishing and managing listings across connected sales channels and suppliers.

We may add, change, or remove features at any time. We aim for high availability but the Service is provided on an "as available" basis and may experience downtime, maintenance, or changes by the third-party platforms we integrate with.

4. Your account

You must provide accurate information and keep your account credentials secure. You are responsible for all activity under your account.

Notify us promptly at the contact address below if you suspect unauthorised use of your account. We are not liable for losses caused by your failure to keep your credentials secure.

5. Subscriptions, billing, and refunds

Paid plans are billed in advance on a recurring basis through our payment processor, Stripe. By subscribing you authorise us to charge the applicable fees to your payment method until you cancel.

  • Subscriptions renew automatically for successive periods unless cancelled before the renewal date.
  • You can cancel at any time; cancellation takes effect at the end of the current billing period and you retain access until then.
  • Fees are non-refundable except where required by law or expressly stated. We may change pricing on reasonable notice, effective from your next renewal.
  • You are responsible for any taxes due on your purchase.

6. Connected marketplaces and suppliers

When you connect a sales channel or supplier (such as eBay, TikTok Shop, Shopify, Amazon, AliExpress, Alibaba, or CJ Dropshipping), you authorise Pulser to access that account through its API and to create, publish, and manage listings and related data on your behalf.

  • Your use of each connected platform remains subject to that platform's own terms and policies, and you are responsible for complying with them.
  • You are responsible for the accuracy, legality, and compliance of the listings, prices, products, and content you publish through the Service.
  • We are not responsible for the acts, omissions, fees, suspensions, or decisions of any third-party platform.
  • You can disconnect a channel at any time, which revokes our stored access for that channel.

7. Acceptable use

You agree not to:

  • Use the Service unlawfully, or to list prohibited, counterfeit, infringing, or unsafe products.
  • Infringe the intellectual property or other rights of any person.
  • Attempt to disrupt, reverse engineer, scrape, overload, or gain unauthorised access to the Service or its systems.
  • Use the Service to send spam or to violate the terms or rate limits of any connected platform.
  • Resell or provide the Service to third parties except as expressly permitted.

We may suspend or terminate accounts that breach these Terms or that create risk for the Service, us, or other users.

8. Your content and data

You retain ownership of the content and data you provide or create through the Service, including your products and listings. You grant us a non-exclusive licence to host, process, and transmit that content as needed to operate and provide the Service (including publishing it to the channels you connect).

You are responsible for ensuring you have the rights to the content you upload or publish and that it does not breach any law or third-party right.

9. AI-generated listings

The Service can generate draft listing content using AI. AI output may be inaccurate or incomplete. You are responsible for reviewing, editing, and approving any AI-generated content before you publish it, and for ensuring it is accurate, lawful, and compliant with each platform's requirements. AI features are provided "as is".

10. Our intellectual property

The Service, including its software, design, branding, and content (excluding your content), is owned by Pulser or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms. No other rights are granted.

11. Third-party services

The Service relies on third-party providers (including Clerk for authentication, Stripe for payments, and the marketplaces and data providers we integrate with). Your use of those services may be subject to their own terms. We are not responsible for third-party services, and their availability or changes may affect the Service.

12. Disclaimers

The Service, including product research, trend data, supplier information, and AI output, is provided for general informational purposes and on an "as is" and "as available" basis. We do not warrant that it will be accurate, complete, uninterrupted, error-free, or that it will produce any particular commercial result. Nothing in the Service is financial, legal, or professional advice.

13. Limitation of liability

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

Subject to that, we are not liable for: loss of profits, sales, business, or revenue; business interruption; loss of anticipated savings; loss of goodwill; loss or corruption of data; or any indirect or consequential loss. We are also not liable for losses arising from your use of any connected platform or from a third party's acts or decisions.

Subject to the first paragraph of this section, our total liability to you for all claims arising out of or relating to the Service is limited to the greater of (a) the fees you paid us in the 12 months before the event giving rise to the claim, or (b) GBP 100.

14. Indemnity

You agree to indemnify and hold us harmless from claims, losses, and costs (including reasonable legal fees) arising from your breach of these Terms, your content or listings, or your violation of any law or third-party right, including any platform's terms.

15. Suspension and termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or its users.

On termination, your licence to use the Service ends. We handle your data after closure as described in our Privacy Policy and Data Retention Policy.

16. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and change the effective date. If a change is material, we will take reasonable steps to notify you. Continued use of the Service after changes take effect constitutes acceptance.

17. Governing law and jurisdiction

These Terms and any dispute arising out of them are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that if you are a consumer you may also bring proceedings in the courts of the part of the UK in which you live. Nothing here affects your statutory rights.
